SOCIAL MEDIA COMMUNITY GUIDELINES

The New Jersey Lottery’s ("Lottery") Social Media Channels, including Facebook, Twitter, YouTube, Instagram and Google+ (collectively "Social Media Channels") are intended to be and should only be used by Lottery fans and players who are 18 years of age or older (collectively "Lottery Social Media Users" and individually "Lottery Social Media User" or "you" or "your"), to engage in fun and interactive conversations with one another, and receive information regarding jackpots, games, news, events and activities, and promotions related to the Lottery. Your use of, participation in, or engagement with the Lottery’s Social Media Channels shall constitute your acknowledgement and acceptance of these Social Media Community Guidelines.

Age Restrictions

The Lottery’s Social Media Channels are directed to and intended to be used by individuals 18 years of age or older. Individuals under the age of 18 must not use any of the Lottery’s Social Media Channels or submit any personal information through any of the Lottery’s Social Media Channels.

Monitoring

Reasonable efforts are made to monitor and moderate the content posted on the Lottery’s Social Media Channels, in order to maintain a community where everyone can feel comfortable. The Lottery’s Social Media Channels are generally monitored Monday through Friday from 8:00 a.m. to 5:00 p.m. ET, excluding holidays. The timely response to postings, inquiries or requests for information by or on behalf of the Lottery may not always be possible and is never guaranteed.

Public Availability and Accessibility

Any information or content posted on any of the Lottery’s Social Media Channels or addressed to the Lottery through any of the Lottery’s Social Media Channels are public records and may be subject to public disclosure under applicable state and federal law, including through the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq., unless an exemption in law exists. In addition, other users of the Lottery’s Social Media Channels may also have access to and use of any information or content posted to the Lottery’s Social Media Channels, and such access to and use of any such information and content is outside of the Lottery’s control. Lottery Social Media Users should not assume any expectation of privacy for any information or content posted on any of the Lottery’s Social Media Channels. For security reasons, Lottery Social Media Users should also avoid posting photographs of winning Lottery tickets with the full bar code visible.

Participation Standards

In order to create a positive and comfortable environment for all Lottery Social Media Users, the Lottery expects a basic level of civility and requests that all Lottery Social Media Users be polite and respectful in their interactions with one another. Lottery Social Media Users may disagree with another’s opinion; however, they must be respectful of others at all times. Profanity, abusive language, insults, illegal content, and threats or harassment of other Lottery Social Media Users, organizations, or individuals are all strictly prohibited. The Lottery will not tolerate, and the Lottery and its social media managers reserve the right in its/their sole discretion, to delete, remove, edit, or hide any content, or ban or terminate any Lottery Social Media User that posts any content, that:

  1. Infringes on the rights of any third party, including intellectual property, privacy or publicity rights.
  2. Includes or references material that is unlawful, fraudulent, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful, racist, indecent, homophobic, sexist, vulgar, or inappropriate.
  3. Includes business advertisements, solicitations, chain letters or pyramid schemes.
  4. Misrepresents a Social Media User’s identity or impersonates another person, business or the Lottery.
  5. Is posted by an individual other than the registered Social Media User of the particular social media channel.
  6. Posts the same note or message more than once or "spam."
  7. Includes or posts pictures, names, likenesses, voices or other indicia identifying any third party, living or dead, without that third party’s permission.
  8. Includes or posts pictures of anyone under the age of 18.
  9. Includes the full bar code of any winning Lottery ticket.
  10. Constitutes an illegal cyberattack.
  11. Contains any nudity or any sexually explicit, lewd, offensive, disparaging or other inappropriate content.

Content and Image Authorization

By submitting or posting any photographs or videos to any of the Lottery’s Social Media Channels, you represent and warrant that you are the sole individual pictured in the photograph or video, that you took the photograph or video, that you own all rights in and to the photograph or video, that no third party material is included in the photograph or video, and the use of the photograph or video by or on behalf of the Lottery will not violate or infringe upon the rights of any third party. By posting any content, information, photographs or videos to any of the Lottery’s Social Media Channels, you irrevocably consent to the use of your name, content, information, photographs, videos, voice and/or likeness (collectively "Content and Image") by or on behalf of the Lottery in any and all of the Lottery’s online, printed and social media advertisements, promotions, publications, illustrations and other Web content throughout the world in perpetuity, including but not limited to the World Wide Web, without payment or other consideration to you. You hereby irrevocably authorize your Content and Image to be edited, altered, copied, exhibited, published and/or distributed, by or on behalf of the Lottery, without any inspection or approval of use by you, for purposes of publicizing the Lottery or for any other lawful purpose. In addition, you waive any right to royalties or other compensation arising from or related to the use of your Content and Image. You hereby hold harmless and forever release, discharge and indemnify the New Jersey Lottery and Northstar New Jersey Lottery Group, LLC, and its/their respective agents, owners, operators, officers, directors, elected officials, members, shareholders, managers, contractors, subcontractors, employees and designees and each of their respective affiliates, from any and all claims, damages, demands, and causes of action which you, your heirs, agents, representatives, executors, administrators, or any other persons, have or may have by reason of this Content and Image Authorization, including without limitation, all claims for invasion of privacy, right of publicity, defamation, false endorsement and any other claims regarding personal or property rights.

Disclaimer and Limitation of Liability

You acknowledge and agree that, to the extent permitted by applicable law, the New Jersey Lottery and Northstar New Jersey Lottery Group, LLC, and its/their respective agents, owners, operators, officers, directors, elected officials, members, shareholders, managers, contractors, subcontractors, employees and designees, and each of their respective affiliates, shall not be liable for any direct or indirect loss, damage (including actual, consequential, punitive, and/or special damages), claim or liability of any kind whatsoever based upon or resulting from, among other things, your participation in, engagement with, or use of any of the Lottery’s Social Media Channels or your reliance upon any content or information posted on any of the Lottery’s Social Media Channels.

Information posted on any of the Lottery’s Social Media Channels should always be verified before you rely upon it. Official winning numbers for Lottery draw games are those selected in the respective drawings and recorded under the observation of the Lottery’s independent accounting firm. In the event of a discrepancy between the official winning numbers for any draw game and the winning numbers identified on any of the Lottery’s Social Media Channels, the official winning numbers shall prevail. Official prize amount information for all Lottery games is the prize amount information in the official records of the Lottery. In the event of a discrepancy between the official prize amount information and the prize amount information identified on any of the Lottery’s Social Media Channels, the official prize amount information shall prevail.

Indemnification

You agree, through your use of, participation in, or engagement with any of the Lottery’s Social Media Channels, to indemnify and hold harmless the New Jersey Lottery and Northstar New Jersey Lottery Group, LLC, and its/their respective agents, owners, operators, officers, directors, elected officials, members, shareholders, managers, contractors, subcontractors, employees and designees, and each of their respective affiliates, from and against any and all claims, damages, actions, liabilities, losses, expenses, and causes of action arising out of or relating to your use of, participation in, or engagement with, among other things, any of the Lottery’s Social Media Channels, your reliance upon any information or content on any of the Lottery’s Social Media Channels, your inability to access any of the Lottery’s Social Media Channels, and/or any breach by you of these Social Media Community Guidelines.

Promotions

Any promotions or sweepstakes sponsored by the Lottery on any of its Social Media Channels will be governed by official rules for such promotion or sweepstakes, which official rules will be located on the particular Social Media Channel offering the promotion or sweepstakes.

Changes to this Social Media Policy

The Lottery reserves the right to update or revise the Social Media Community Guidelines at any time and without notice by posting new Social Media Community Guidelines at this location. Your continued use of, participation in, or engagement with the Lottery’s Social Media Channels shall constitute your acknowledgement and acceptance of such new Social Media Community Guidelines.
